In the case of camera failure, inclement weather, or any other unforeseen incident that prevents Photo Web Concepts LLC from shooting on a scheduled date the client will get a full refund of their deposit if applicable. No refund will be given under any circumstances if you fail to attend the activity on the day and at the time listed, when the booking was made.
Due to the nature of digital photography and the fact that photographs, once sent, cannot be returned; photo Web Concepts LLC has a strict NO REFUNDS POLICY. Once a transaction has been completed (i.e., the buyer selected and paid for the photos and video and then Photo Web Concepts LLC sent the buyer the correct photograph) it is then considered non-refundable.
If a buyer has selected and purchase an incorrect photo, he/she must notify Photo Web Concepts LLC, before receiving the “incorrect” photograph. Refunds will NOT be given due to “not liking a photo”, selecting an incorrect photo after the buyer has already received the photograph, or any other reason.
If a mistaken photo is sent to the buyer, as documented on the invoice, Photo Web Concepts LLC will send the correct photo to the buyer free of charge.
Refund/Exchange Policy for Custom Wedding Albums and Photo Books
Due to the custom pre-designed nature of these services, there are no refunds on any design order. Albums ordered are considered a custom product and therefore there are no refunds on any album orders. Flush Mount and Coffee Table Books are made to order and cannot be returned or exchanged unless:
- a manufacturer defect is evident and reported within 48 hours (2 business days) from the date it was received,
- damaged during shipping (a separate claim must be filed with the shipping carrier and also must be reported within 48 hours after being received),
- or in the even that the order was erroneously process such as an error was made on the size of the book or color/style, compared to the original recorded order.
Policies All prints and products are subject to your state sales tax and shipping when applicable. Due to the nature of custom photography, all sales are final. Photo Web Concepts LLC does, of course guarantee that the portraits you receive meet the highest standards in every respect and works with the customers to approve designs and custom work before orders are placed. Payment of orders is due in full when the order is placed. Prints and products arrive 4-6 weeks after payment is received. Albums take approximately 10 weeks as they are custom designed and hand made. Rush shipment is available on some items for an additional charge. All rates are subject to change at any time. In the interest of fairness to all customers, all rates are non-negotiable unless booked through a special promotion.
Nonrefundable Retainer Fee/ Full Payment. Client agrees to pay amount show on the quote provided (Include % or amount that needs to be paid to be retained.) of the full amount due retain Photographer. Client understands and agrees that Photographer is foregoing other employment by entering into this Agreement to secure the Client’s session date/time on the Photographer’s calendar, and therefore, also agrees and understands that the paid retainer is nonrefundable. The remaining balance is due the day of the actual event.
Rescheduling/Canceling. Photographer may reschedule the session due to Photographer’s illness or inclement weather and will work with Client’s schedule to reschedule as soon as possible. If Client needs to reschedule due to illness of anyone involved in the session, Client will do his/her best to notify Photographer at least 48 hours prior to the session or at least as soon as possible after the issue is identified. The nonrefundable retainer fee can be transferred to another day and time upon the rescheduling of a session, so long as the rescheduled session takes place within 3 months of the original session date.
Refunds. Due to the custom nature of custom product and commercial photography, digital files cannot be returned and all money paid is nonrefundable.
Digital Files. Approximately _7 Days_____ (Provide approximate turnaround time.) after the session date, the agreed-upon number of digital files will be available for viewing and downloading from an online, password-protected gallery. Client agrees and understands that Photographer, in their sole artistic discretion, decides which images taken during the session will be edited and presented in the Client’s gallery; not all images taken during the session will be presented to the Client.
Editing. Client agrees and understands that Photographer edits the proofs at their own artistic discretion, and said editing is included in the session fee when the project has been quoted
Archive and Storage. The Photographer archives all proofed images from each session for a period of ____90 days_____________ (Decide how long you want to keep images, ex: 1-3 years.) from the date of the session. After that time, the Photographer deletes all proofed images from their hard drive and all external hard drives. The Photographer is not responsible for digital files once they are downloaded by the Client. The Client is responsible for making electronic back-up copies of any digital files that are purchased from the Photographer and for keeping them in a safe place.
Force Majeure Photographer will not be liable to the Client for any loss resulting from an act of God, natural disaster (including but not limited to fire, earthquake, storm, hurricane, flood, lightning, and tornado.
Model Release. Client is responsible for obtaining the necessary model releases for the models arranged to participate in the shoot. Client will provide the signed model release to the photographers prior to the start of the shoot. Lack of model release allows photographer to refuse to photograph person. Client hereby releases Photographer and his/her legal representatives, heirs and assigns from any and all claims and liability relating to the photographs.
Severability. If any provision of this Agreement is declared void or unenforceable, such provision shall be severed from this Agreement, which shall otherwise remain in full force and effect.
Amendments. Any amendments made and agreed upon must be in writing and signed by both the client and photographer.
